FILM MAKER AGREEMENT
These Terms & Conditions (“Terms”) govern the submission of films (“Film” or “Films”) by filmmakers, producers, or rights holders (“Filmmaker”) to the Scottish Outdoor and Adventure Film Tour (“Tour”). By submitting a Film, the Filmmaker agrees to these Terms.
1. Eligibility and Submission
1.1. The Filmmaker warrants that they are the rightful owner of, or have secured all necessary rights, licenses, and permissions in relation to the Film and all materials submitted.
1.2. The Film must not infringe upon the rights of any third party, including copyright, trademark, or privacy rights.
1.3. Submissions must comply with the deadlines, formats, and technical requirements outlined by the Tour.
2. Selection and Screening
2.1. Submitted Films will be reviewed by the Tour’s selection committee, and inclusion in the Tour program is at the sole discretion of the Tour.
2.2. Selected Films may be screened at multiple venues across the duration of the Tour.
2.3. The Tour reserves the right to determine screening dates, times, locations, and formats.
3. Rights Granted by the Filmmaker
By submitting a Film, the Filmmaker grants the Tour the following non-exclusive, royalty-free rights:
3.1. Screening Rights – To exhibit the Film at any venue, city, or country that forms part of the Tour.
3.2. Promotional Use – To use the Film, in whole or in part, and/or supporting materials (including posters, stills, trailers, teasers, and synopses) for:

Festival and Tour promotion (print, online, social media, television, radio, and other media).

Sponsor and partner promotion in connection with the Tour.

Press and media coverage relating to the Tour.
3.3. Archival Rights – To retain a copy of the Film for non-commercial archival purposes and possible retrospective screenings at future Tour events.
4. Intellectual Property
4.1. All intellectual property rights in the Film remain with the Filmmaker.
4.2. The Filmmaker confirms they have cleared all third-party rights (including music, footage, and likeness rights) for public exhibition and promotional use.
4.3. The Filmmaker indemnifies the Tour, its organisers, sponsors, and partners against any claims arising from breach of intellectual property or other rights.
5. Marketing & Publicity
5.1. The Tour may create marketing campaigns featuring stills, clips, or the entire Film to promote the Tour.
5.2. The Filmmaker agrees to provide the Tour with promotional materials (e.g., trailers, stills, press kits) upon request.
5.3. The Tour may edit excerpts of the Film (up to 3 minutes in total) for promotional purposes. Longer excerpts may be used only with the Filmmaker’s consent.
6. Warranties and Representations
The Filmmaker warrants that:
6.1. They are fully authorised to submit the Film and to grant the rights outlined in these Terms.
6.2. The Film does not contain unlawful, defamatory, or obscene material.
6.3. All rights, consents, and licenses for music, performances, and appearances have been obtained.
7. Liability and Indemnity
7.1. The Tour will take reasonable care of submitted materials but is not liable for any loss, damage, or theft.
7.2. The Filmmaker indemnifies the Tour against all claims, damages, or liabilities arising from breach of these Terms.
8. General
8.1. Submission of a Film implies acceptance of these Terms.
8.2. These Terms shall be governed by the laws of [Insert Jurisdiction – e.g., England & Wales], and any disputes shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
8.3. The Tour reserves the right to amend these Terms at any time, with notice provided to participating Filmmakers.
